Intentional Torts

The attorneys of Harman Claytor have successfully defended individuals, businesses, and public and private organizations against allegations of intentional harm to persons and property. These cases have included claims for assault, battery, defamation, malicious prosecution, false imprisonment, intentional infliction of emotional distress, trespass, fraud and interference with contract or prospective business advantage.

The issues that may arise in an intentional tort case are much different than those typically confronted by attorneys who handle ordinary negligence and personal injury claims. As the issue of intent is often critical, an effective defense requires a complete command of the factual background leading up to the alleged injury, including the relationship between the parties, the possible motives for the allegedly intentional conduct. Defamation cases can be particularly complex because of the protection afforded by the First Amendment to certain types of speech. The attorneys at Harman, Claytor who handle intentional tort claims understand the importance of these issues and have the experience to obtain and interpret the relevant evidence so as to best assist our clients in meeting the allegations against them.
