Long Term Care Litigation
Harman Claytor has built a team of litigators dedicated to the defense of claims against long term care providers. These attorneys practice out of our Richmond and DC Metro Offices, routinely handing matters in Virginia, Maryland and the District of Columbia. As the industry has evolved our team has grown, gaining experience in defending skilled nursing facilities, assisted living facilities, and home health care agencies.
The Long Term Care Team has a depth of experience that allows the early identification of key issues and witnesses resulting in the early assessment of exposure. We have defended personal injury and wrongful death claims involving issues of wound care, elopement, strangulation, choking, medication errors, sexual abuse, assault, falls, fractures (explained and unexplained) the use of chemical and physical restraints, weight loss/malnutrition and mechanical lifts.
The Long Term Care Team has successfully defended care facilities at trial and arbitration in cases involving a fall from a wheel chair, a fall from a mechanical lift, infections and a home care provider in claims for vicariously liability, negligent hiring and retention in connection with a sexual assault.
The Long Term Care team understands the importance of thorough chart review pre-suit to identify issues and key witnesses. The partners, associates and paralegals work together in interviewing staff, gathering pertinent pre and post incident medical records and retaining highly qualified experts in the fields of wound care, internal medicine, geriatric and palliative care.
Our team also represents nursing homes and other long term care providers under investigation for Medicare and Medicaid Fraud.
