Consumer Litigation

Litigation experience in defending consumer cases

Harman Claytor’s Consumer Litigation Defense Practice Group specializes in meeting the unique legal needs of our consumer litigation clients in Virginia and the Washington, DC area. We have in-depth familiarity with the statutory, regulatory, transactional, and litigation issues affecting motor vehicle and recreational vehicle manufacturers and dealers, credit reporting agencies, lenders, and related entities. The claims we handle include individual and class action matters involving state unfair and deceptive trade practices laws, negligent and intentional fraud, breach of contract and warranty, Fair Debt Collection Practices Act (“FDCPA”), the Fair Credit Reporting Act (“FCRA”) and Truth in Lending Act (“TILA”). We also proactively advise clients on matters of compliance with all consumer protection laws to preclude litigation.

We are sensitive to the fact that even highly defensible claims can be expensive to litigate and pose a risk of significant exposure to our clients, as many consumer laws provide for an award of attorney’s fees to the prevailing party. Thus, we believe early evaluation and resolution is essential. If a reasonable early resolution cannot be achieved, our consumer litigation lawyers are highly experienced in representing clients in arbitration and state and federal courts.  We believe in developing a strong partnership with our clients to achieve the best possible outcome.
