Michael’s legal experience has taken his practice to Louisiana, Minnesota, and now Virginia.  He joins Harman Claytor as a senior associate.  He has worked in products liability and prior to that in legal collections and Fair Debt Collection Practices Act defense.  He also served as the law clerk to the Honorable Christopher J. Bruno in New Orleans, Louisiana, in the Civic District Court for the Parish of Orleans, and as an extern for the Honorable Joseph C. Wilkinson, Jr., Magistrate for the United States District Court for the Eastern District of Louisiana.

  • Smith v. Stewart, Zlimen & Jungers, Ltd., 990 F.3d 640 (8th Cir. 2021) – In an opinion upholding Michael’s Motion to Dismiss, the U.S. Eighth Circuit expanded its caselaw shielding debt collectors from civil suits based on their good faith prayers for relief.
  • Successfully defended his bench trial defense verdict before the Minnesota Court of Appeals.  The appellate court affirmed the state’s caselaw on qualified witnesses under the business records exception and clarified existing law on the state’s “account stated” doctrine.  LVNV Funding, LLC v. Wilks, 2021 Minn. App. Unpub. LEXIS 48 (Jan. 11, 2021).
